Failed in committment of repayment of principle with interest invested in conditional stock market business without agreement

► Invested Rs.130000 in business (Stock Trading) through office cauligue with condition of 6-8% monthly return and commitment of repayment of principle + Interest of 1% pm if business failed, 3 years left but all commitments failed. I have cancelled PDC cheque from him which was not subimitted as he requested not to submit at bank as he had no balance in his account and bounce back charges was applied. He is not denying or confirming the payment date. He is just delaying all the time by saying that he is trying. I have all the communication in whatsapp also all transactions were done to his brother's bank account. Also I have not any legal agreement of that business, he just explained me on plain paper about the business plan and how return would be calculated. and he is saying that I can't take any legal action against him if he deny to pay. So don't push him to pay. He will pay whenever he get money. Please advise how to take it legally.

Even without a formal written contract, you can pursue civil recovery of your money using evidence such as bank transfer records, WhatsApp Messages, the plain paper note explaining the business plan, call logs, details of the account and other relevant documents as proof of the transaction. If he never intended to repay or diverted funds to his brother’s account dishonestly or with wrongful intention, you may have grounds to file a criminal complaint under the Bharatiya Nyaya Sanhita, 2023. 

A suit for recovery of money under contract is governed by the Limitation Act, 1963, and the general limitation for suits based on debt is three years from the date when the cause of action arises. If instalments were promised monthly and he defaulted earlier, the clock starts from each due date. Your first step must be to send a lawyer’s demand notice demanding payment. If this does not work, you may file a writ petition, asking for interim relief such as attachment of movable property or an order for interim payment.
