► Hello dear sir/mam My name is viral Bambhaniya Me crpf me training me tha or 5 week training ki thi kuch health issues hua tha jiski vajah se mene resign de diya tha or training cost bhi ja ma kar di thi mene rejoining ke liye dg crpf delhi ko application bheja lekin vaha se post aya or decline ho gya, kya aap is baare me muje koi solution de sakte ho mene 1 june ko resign diya tha

I understand your legal query and would like to help you with my expert opinion. That under the Central Reserve Police Force (CRPF) Rules, it is clearly mentioned that once you have resigned and the resignation is accepted, there is no direct provision relating to withdrawal of resignation or rejoining.

Since your application was rejected earlier by the Director General of the CRPF, you can file a  Mercy Petition or Review Petition in the Director General's Office or with the Ministry of Home Affairs along with your medical documents, stating that you were forced to resign because of your illness. If your appeal gets rejected, then you can file a Writ Petition under Section 226 in the Hon'ble High Court.

Once your resignation is approved and you are officially relived from the CRPF, you no longer have a legal right to get your old job back. But in case you have resigned due to health releted reasons then you can send a legal notice to the competent CRPF authority through a lawyer, the document must highlight that you were compelled to resign due to illness under the CRPF Act, 1949 and its rules. If your appeal to the Director General is denied, you may file a writ petition under Article 226 of the Indian Constitution at the appropriate High Court.

Dear Client, 

In the event that your resignation from CRPF has been accepted and your application to be allowed to rejoin has been turned down by the Director General, CRPF, rejoining will not be your legal right. But in case you have resigned on the grounds of being medically unfit and you think that your representation has been declined without any reason or goes against the provisions of CRPF regulations, you can demand the reasons for your decline and contest the same through a writ petition filed under Article 226 of the Constitution at the concerned High Court.
