► Thanks a lot for your kind suggestion for vacating the possession of one room of my house . I further say that the house recently repaired and whitewashed leaving one almirah and one palang in the room removing other goods . The land is in the name of my father but his handwritten WILL says that I may build a house on the plot,where I built a two room house , at my own cost if you can . The WILL having two witness but my father and witness are not alive . What to do please guide as they are waiting for entering the room after whole work needed although I am sleeping in that room placing my palang . Little work is pending in the room.

Dear Client,

Based on your legal query, I suggest that in order to prove your father's will and to protect your room's possession. Firstly, do not vacate the possession.

Secondly, you can send a legal notice through an advocate to the people who are waiting to enter the property or are trying forceful entry, to warn them that legal proceedings will follow if they try to trespass the said property.

You can also file the injunction Petition against your property under Order 39 of The Civil Procedure Code,1908 for any trespass or forceful entry.

Lastly, you can file a petition in the District Court for authenticating the will left by your father and along with that you can submit the Original Will, Death Certificates, All Construction and Repair Bills, any old family documents containing your fathers and the deceased witness handwritten signatures.
