Dear Client,

Based on the facts provided, since you are medically sensitive to cold and have documentary proof from doctors, you are entitled to request reasonable accommodation in your hostel. Denial of a blower despite medical necessity may amount to arbitrary and unreasonable treatment, especially if it affects your health and ability to attend classes or exams. While the Dean of Students’ Welfare has refused, you can escalate the matter by filing a written representation to the college administration and, if necessary, approach the District Education Officer or State Education Department.

Legally, you may also seek relief through a writ petition before the High Court under Article 226 of the Constitution of India, citing violation of your right to health and education. Courts have recognized that institutions must act reasonably when a student’s health is at stake. In the meantime, you should preserve all medical records, correspondence, and any refusal letters from the hostel staff or college authorities.

Given the seriousness of your health condition and the need to balance your education with medical requirements, you may take a one-on-one consultation with our office to plan the appropriate legal steps and ensure your rights are protected.

Hope this clarifies your position.
