► I am 25 years old. My family is forcing me to get married to a boy of their choice in May. I do not want this marriage because I want to marry my boyfriend by my own choice. My family is putting a lot of pressure on me and sometimes they also hit me. I want to know what legal protection I can get and what steps I can take to stop this forced marriage and marry the person of my choice. Also, I have kept my personal documents with me for safety. Can my family file a theft case against me for that?

Can Your Family File a Theft Case for Taking Your Documents?

No. If the documents belong to you, it is not theft.

Examples:

Your Aadhaar

Your certificates

Your passport

Your personal bank documents

Keeping your own documents for safety is completely legal.

Stay with a trusted friend or relative.

Inform the local police station about your situation.

Keep copies of important documents and evidence of threats.

Dear Client, 

If you are in immediate danger, call the police, go to the nearest police station, and request protection. You can also call the national women's helpline 181 for urgent assistance and shelter, or reach out to a safe place with a friend or relative. If you have any injuries, go to a hospital and get a medico-legal certificate and treatment records, as this constitutes important evidence. Preserve the photos and videos of injuries, if any. Being an adult, it is your fundamental right to choose a partner of your choice, and no one can force you to marry against your will. Consent is an essential for any valid marriage, and one obtained by coercion or force can be cancelled or annulled.  

Through the Bharatiya Nagarik Suraksha Sanhita (BNSS), you can invoke Section 350, 352 for criminal force or assault for causing hurt. If their hitting results in injuries, Section 323 can be invoked for voluntarily causing hurt. You may seek protection orders or residence orders under the Protection of Women from Domestic Violence Act, 2005. You may also approach the local Women’s Cell or Mahila Thana. You can file an FIR at the local police station for assault or harassment, as may be applicable, in order to seek protection. Simultaneously, you can approach the Protection Officer or file an application under Section 12 of the DV Act with the magistrate seeking protection and residence orders.  

With reference to the theft claims, your family cannot file a theft case legitimately, considering that these are your documents and you have every right to keep them for your safety. This does not constitute theft. Theft requires the presence of an act of dishonestly taking someone else’s property. If you have any further queries, please feel free to contact us.

You are an adult, you have a choice of marriage and you can marry anyone you want. If you family is threatning you with any case or hitting you then please visit the nearest police station and infomr them all the harrasment and threats that you are facing. The police will take appropraite action. They will register NC or FIR.
