Submit a written objection stating:

You are a Class-I legal heir.

Your name is deliberately suppressed.

Certificate cannot be issued without including all legal heirs.

Request inclusion of your name.

Attach:

Your Aadhaar

Birth certificate / School records (showing parent’s name)

Death certificate of deceased

Family tree (if available)

Dear client

If your siblings obtain a legal heir certificate that does not list you as one of the heirs, you can dispute it and request that your name be added. All legitimate heirs of a decedent must be included in the records of their estate on file with the county recorder.

 

To have your name added to the heir's certificate, you must visit the Taluk Office or Revenue Office similar to where the heirs certificate was issued, and request that you be added by providing proof of your status as a legal heir via supporting documents e.g. your birth certificate or any proof of relationship with the actual decedent (such as Aadhaar Card, Ration Card, etc.)

You also have the option of issuing a written complaint regarding your omission from the certificate due to clerical error.

If your request for having your name added to the certificate is denied by the Tahsildar, you may sue your siblings who applied for the heir's certificate or the Tahsildar or both by filing a civil suit to obtain a judicial declaration that you are a valid legal heir. Once the civil court renders its judgement and determines you are a legal heir, a new heir's certificate will be filed to include your name.
