► My mother transferred her property to my sister through gift deed in Dec2020 without family's knowledge. My sister refurbished the property and then sold it in July 2025, which was in my knowledge. Can i file a case for my share in the sale proceeds?

Dear Client, as per your query, since the property was gifted in 2020 and sold in 2025, your claim is entirely dependent on what exactly this property is. If it is your mother’s self-acquired property (one that she bought or inherited), then she had every legal right to gift it to your sister without your permission, and you would not have any legal right to claim any of the proceeds. If it is an ancestral property (one that has been passed down through four generations of men in a direct family line), then you would have a birthright to contest this and demand a share of this property. In order to contest this, you would need to file a civil suit to annul this gift deed of 2020 on the grounds of fraud, coercion, or lack of mental capacity, although this would require you to file it within a period of three years of discovering this, which may already have passed unless you can prove you only recently discovered the transfer.  I hope this answer is helpful. Thank You.
