Failed in committment of repayment of principle with interest invested in conditional stock market business without agreement

► Invested Rs.130000 in business (Stock Trading) through office cauligue with condition of 6-8% monthly return and commitment of repayment of principle + Interest of 1% pm if business failed, 3 years left but all commitments failed. I have cancelled PDC cheque from him which was not subimitted as he requested not to submit at bank as he had no balance in his account and bounce back charges was applied. He is not denying or confirming the payment date. He is just delaying all the time by saying that he is trying. I have all the communication in whatsapp also all transactions were done to his brother's bank account. Also I have not any legal agreement of that business, he just explained me on plain paper about the business plan and how return would be calculated. and he is saying that I can't take any legal action against him if he deny to pay. So don't push him to pay. He will pay whenever he get money. Please advise how to take it legally.
