► I am working at dockyard as a central government employee and I want to start a transport business is it possible and if not is there any way to go around this law (my father is also government employee)

Dear Client, 

As a Central Government Employee, your default position is that you cannot directly or indirectly engage in any trade or business without the previous sanction of the Government under Rule 15[1] of the CCS [Conduct] Rules. The broad rule covers engaging in trade and business, undertaking other employment, holding elective office, etc. A transport business in plainly a trade or business so if you want to run it yourself, or control it through someone else, you should assume it falls within the rule and needs prior sanction. Clause 2 allows only limited exceptions, but transport business does not fall within those exceptions. Your father being a government employee does not create a loophole. If he is the own who will own, manage and control the business, he is also separately bound by the same conduct rules. If any member of your family in engaged in trade or business, Rule 15[3] requires reporting. 

Hence, the practical course of action will be to apply in writing for prior permission or sanction from your competent authority under Rule 15[1] before starting anything. If you want to be involved only as a passive investor, it is suggested to take legal advice first and seek sanction anyway. If you wish to undertake a clean, risk-free route, the safest option would be to start the business only after leaving government service. I hope this answers your queries.
