► I, along with seven other tenants, reside in a cessed Pagdi building in Mahim, Mumbai, and seek guidance regarding redevelopment and tenant representation.
1. As our 70 year old building has only eight flats, can we form a Co-operative Society despite the usual ten-member requirement, or would an AOP suffice for redevelopment and government liaison purposes?
2. What is the procedure for forming an AOP? Please share any format, template, or bye-laws.
3. What documents are required from tenants? Is a joint bank account needed, and is AOP registration mandatory?
4. Are regular meetings and maintenance of accounts/records required as in a Co-operative Society?
5. The landlords have neglected the property, not collected rent for 15+ years, defaulted on property taxes, and not updated the Property Card after the demise of listed owners. All tenants support redevelopment, but the landlords are unresponsive. What legal remedies and steps can tenants take to initiate redevelopment?

Regarding your first question, a Co-operative Housing Society under the Maharashtra Co-operative Societies Act generally requires a minimum of ten members. Since your building has only eight flats/tenants, registration of a standard co-operative society may not ordinarily be possible unless additional eligible members exist, such as shop occupants or co-owners. In such circumstances, tenants commonly form either:
- an Association of Persons (AOP),
- a Condominium/Apartment Association, or
- an unregistered tenants’ association initially for redevelopment purposes.
It is advisable to maintain regular meetings, resolutions, attendance records, accounts, correspondence files, notices, and redevelopment documents, even if you are not a formal co-operative society. Proper documentation becomes crucial in redevelopment disputes and court proceedings.
