► I am a Hindu woman currently living in Dubai. I got married through an Arya Samaj marriage in India about one year ago after approximately two years of courtship.
The marriage has never been consummated and I remain a virgin. My husband consistently avoids any discussion regarding physical intimacy and never gives any explanation. He does not respond when I ask about my marital rights.
He has also refused to cooperate in registering the marriage and does not properly acknowledge me as his wife. There have been incidents where he insulted my parents and caused me significant emotional distress.
I have an Arya Samaj marriage certificate, wedding photographs, and WhatsApp messages showing my attempts to discuss these issues and his avoidance or non-response.
I had anxiety before marriage and disclosed it to him during courtship. I was under psychiatric treatment, but I am employed and financially independent.
My questions are:
1. Do these facts support annulment, divorce, or both?
2. Can non-consummation and refusal to discuss intimacy amount to mental cruelty?
3. Since we currently live in Dubai but married in India, where should proceedings be filed?
4. Can most of the process be handled remotely?
5. Does my previous anxiety treatment affect my legal position if it was disclosed before marriage?
