File an Application under Section 152 CPC for Correction
Legal Basis: Section 152 of the Civil Procedure Code allows for correction of clerical or arithmetical mistakes or accidental omissions in judgments, decrees, or orders.
Steps:
File an Application under Section 152 CPC before the same court which passed the ex parte decree.
Mention that the survey number was inadvertently omitted and request the court to incorporate the correct survey number of the property.
Enclose:
Copy of the plaint and decree.
Relevant land records (RTC/Pahani, Sale Deed, Property tax receipts, etc.) to establish the correct survey number.
Serve notice to the defendant (even though ex parte) to avoid later objections.
✅ 2. After Correction, Get the Certified Copy of the Amended Decree
Once the court allows the application and issues an amended decree/order with the survey number included, collect:
Certified copy of the corrected judgment and decree.
Covering letter or court order showing the correction under Section 152 CPC.
✅ 3. Resubmit the Corrected Order to the Registrar
Submit the corrected certified copy of the permanent injunction decree (with survey number) to the Sub-Registrar Office along with a formal letter requesting them to:
Record the injunction in their books,
Prevent further illegal/fraudulent registrations related to the said property.
🛑 Optional Parallel Step: Register the Court Injunction Order (if allowed)
In some states (like Karnataka, Maharashtra), the injunction order itself can be registered under Section 17(2)(vi) of the Registration Act to make it binding upon third parties.
✅ 4. Keep Police Informed if Illegal Sale Attempted
If the defendant is still attempting to sell/transfer the land, despite the injunction:
File a police complaint attaching the court decree and injunction.
Also, move a contempt petition under Order 39 Rule 2A CPC
