Dear Client,
I would like to clarify your doubt regarding this query raised by you by giving you a legal opinion. That is, as per your query, I would like to say that under the Right to Information Act,2005, a Public Officer or First Appellate Authority cannot be requested to recuse themselves from disposing of an RTI application or Appeal. Their duties are statutory in nature and bound by law to perform them. The sanctity of such an order cannot be void ab initio, until it is set aside by a higher authority, and can be challenged for a second appeal. Hope this answers your question.
