► Sir ,I have taken mortagage lone ,bank taken property ,valued Rs.6 Cr and sanctioned Rs 269.47 lakh and not disbursed remaining Rs.185.53 lakh .In 25 months I paid Rs.135 lakh as intrest and EMI .My account was not NPA ,even bank auctioned property in Rs.317 lakh ,and machinary Rs.5 Cr.auctioned which are not financed by bank.Sealed running factory removing 20 worker without notice ,no DM order .In demond notice,bank demond Rs 260 lakh and collected Rs.317 lac from auction of property .After collecting full amount ,even bank attached ,Gaoruntors property of Rs 10 Cr .And bank not return excess amount and shear deposite of Rs. 12 lakh .In auction process bank not followed RBI Guidlines and even after sale certificate issued ,bank collected after 208 days bank credited amount in my account . Even case is in DRT Pune court ,next hearing on 28 may 2025 .Bank not Honored DRT order .Bank auctioned non financed machines and not mentioned in auction notice .

You can file Writ Petition in the High Court explaining derailed irregularities and violations by the Bank. Co-op banks are usually in violations on different footings. Procedural aspects would debar your interest and harm you with irreparable loss of money and peace. Approach High Court through Writ Petition immediately. The present advice is without prejudice and without going into documents and factual details so act accordingly and feel free to contact us if required. Dear Sir, Since the matter is pending before DRT as such you may take appropriate advise from your Advocate on record and act accordingly.

From the information that is being provided the issue majorly revolves around excess money held by the bank, non-compliance of RBI guidelines and DRT’s order in the matter at hand. If that is the case, then you can either file a separate petition to initiate contempt of court (for non-compliance of the courts order) and another petition to recover the excess money or inform the court of the violations committed by the bank in the next hearing through your advocate. The latter will minimize the time taken to resolve the issue as the court has competent jurisdiction to deal with the matters at hand. Kindly discuss with your advocate before taking any steps.
