► My aunt executed a registered Sale Deed in favour of my father on 3 March 2023, thereby transferring the property to him. After nearly three years, in 2026, she filed a Suit for Declaration alleging that my father had obtained the Sale Deed by fraud and misrepresentation.
Her case is that she intended to transfer the property to both of her brothers out of love and affection. She alleges that my father took her to the court by representing that the property would be transferred jointly in favour of both brothers, whereas the Sale Deed was ultimately executed solely in my father's name.
On the basis of these allegations, she has sought to restrain my father and our family from entering or dealing with the said property.
However, these allegations are false. At the time of execution and registration of the Sale Deed, my father clearly informed her that the document was a Sale Deed, and she executed it with full knowledge and understanding of its contents. The agreed sale consideration was also paid to her. Despite this, she has now filed a false suit after almost three years, alleging fraud and misrepresentation
