► Hello Lawyer,
I live in Vadodara city.
The building that I live in, a Roof top Solar panel work has just been completed. I am not sure of whether the society has followed proper waterproofing solution during the installation process, I feel they haven’t.
I live on 5th floor & the terrace is right above me. I want to know of my legal rights.
I have an expensive home theatre installed in my living room. In next year or years thereafter, if during monsoon, my living room ceiling suffers from leakage issues due to this drilling on mosaic tiles of the terrace surface so as to install Solar panel, or leakage otherwise, do I have the legal rights to claim compensation for the damage done to my expensive home theatre system due to this terrace leakage reaching the inner ceiling along with damages to walls as well?
Also, it will be a complete responsibility of my society to get the leakage issue properly fixed - both from outside as well as inside, right? I am referring to the terrace above my flat & the ceiling inside my living room.
How do I need to get sign from the key committee member on a paper accepting this, especially if they are adamant, rude or refused to do so?
Or that they try to “Politically” trap me into some bad case, just b’coz I took this paper to them for signing & securing my home & home theatre system from leakage due to terrace leakage in future?
Maybe they don’t like me asking them to sign such type of an indirect legal document so instead, they trap me into some wrong legal notice & mentally harass me?
