► im a female 20 year old student, ive been diagnosed with depression and i was suffering from it for quite a long time now. my family is mentally torturing me i dont wish to keep any relation with them so i want to leave my home and my family but i wish to do it legally because if i run away from the house my life will become a living hell. i have figured it out what im going to do later. so for now i need legal help i really need help.

As an adult, you have the right under Articles 19 and 21 of the Constitution to live independently and choose your own residence, and your family has no legal authority to detain you or compel your return once you leave. Ensure that you pack all your personal identification documents, such as Aadhaar, PAN, passport, and academic certificates, as they belong to you and cannot be retained under any circumstance.

To protect yourself against a false missing-person or kidnapping complaint, submit a written intimation to your local police station stating that you are a major leaving voluntarily due to the harassment you have described. Make sure that you have only your own bank account in your name and register yourself with your mobile number, along with taking simple measures for maintaining your privacy on your devices. There is no formal procedure of law for disconnecting yourself from your family once you become an adult, but still a public notice of independent life can be issued, if you want to keep it as a record. Due to the fact that your family members harass you, you should know that the Protection of Women from Domestic Violence Act, 2005 also covers the women from family members in a joint household.  Based on your legal query, I suggest you my legal opinion. That you are 20 years old and you are major and you can take independent decisions, Your parents cannot force you to live with them or restrict your movement.

You can approach your nearest police station and submit a written letter of voluntarily living the house due to ongoing mental harassment in the household, you are safe and sound and has been forced by anyone or being kidnapped by anyone.
