► Hello, I would like to get a free legal consultation regarding my marital situation. I am currently living with my in-laws and am considering leaving the matrimonial home and proceeding with separation/divorce. My husband has been unfaithful, and I have screenshots and voice recordings that I believe may be relevant evidence. I am also concerned about harassment and threats from my in-laws. I have some of my own gold with me, but my in-laws have told me that if I leave, they will not return the gold items that were given to me by them during/after my marriage. They have also said that they will not give me my educational degree/certificates that I obtained after my marriage. My father-in-law has also threatened me with cyber-security/police action because I had access to my husband's Instagram account/details. I want to understand whether this threat has any legal basis and what I should do about it. I want to know my legal rights regarding my gold/stridhan and educational certificates, how I should preserve my evidence, and what steps I should take before leaving the matrimonial home to protect myself and my belongings. I would be grateful for a free consultation and guidance on how to proceed safely and legally.

Dear Client,

Gifts to the wife before, at or after marriage are her absolute property (Section 14 HSA), and the in-laws hold them only as trustees. Refusal to return them after demand attracts Section 316 BNS (criminal breach of trust), and retention used to coerce her is cruelty under Sections 85 and 86 BNS. Withholding stridhan is also economic abuse under the Domestic Violence Act, 2005, and the Magistrate can order its return under Section 19(8). You should prepare an itemised inventory with photographs and bills and send a written demand so that demand and refusal are on record. The certificates are your personal documents and can be covered by the same application, while duplicates from the university remove the leverage in practice.

For the Instagram usage, Sections 43, 66 and 66C of the IT Act require unauthorised access and dishonest or fraudulent intent, so if the password was shared or the account was open on a household device, proving it under these sections becomes harder. The threat of a false case to stop you leaving is itself criminal intimidation (Section 351 BNS). You should not access the account again, and anticipatory bail is available under Section 482 BNSS if you are ever summoned.

Moreover, adultery is a ground for divorce under Section 13 HMA, alongside cruelty. You should keep original, unedited files on the original device, back them up, log dates and participants, and expect to need a Section 63 BSA certificate.

Lastly before you leave, you should take your identity documents, financial papers, phone, gold and receipts, and give written intimation to the police, husband and in-laws that you’re leaving because of infidelity and harassment, to pre-empt a desertion claim. Your right of residence under Section 17 of the PWDVA continues. You can apply to these sections for remedies, such as Section 12 under the PWDVA, a complaint under Sections 85/86 and 316 BNS, and a divorce petition (interim maintenance under Section 24 HMA), all of which can be filed where you reside.

Dear Client,

Depending upon the situation, facts, and documents related to your marriage, you have a number of legal remedies available, but all will depend upon what is applicable in your case.

Stridhan normally belongs to the woman, and the fact that gold articles were presented to you as gifts by your in-laws does not, in any way, mean that you lose them when you leave their home. It has been ruled by the Supreme Court that a woman has the right to claim back her stridhan through legal action, and even under the Protection of Women from Domestic Violence Act, 2005.

It is essential that you make a list of gold and other belongings, keep your bills, photographs, wedding details and correspondences proving ownership or a gift, and have copies of your educational certificates stored securely. Don’t give up originals unless required to do so.

Screenshots and voice recordings must be preserved as originals along with dates and other relevant information. Electronically stored documents are evidential in accordance with the provisions of Bharatiya Sakshya Adhiniyam, 2023.

Coming to the issue of Instagram account, there are several aspects involved. The fact alone that you gained unauthorized access to the account does not amount to any criminal liability but unauthorised access, copying, dissemination of information could lead to other legal liabilities. Hence, it is advisable for you not to use the account anymore.

In case you feel that there is a threat to your safety and you are scared for your life, then it is necessary that you seek out protection.

I hope this answer helps. If you have any further query kindly do not hesitate to contact us. Thank you.

Dear Client,

Based on your legal query, I suggest you my legal opinion;

1. Stridhan & Educational Documents

Stridhan: All jewelry, gifts, and ornaments given to you before, during, or after marriage (whether by your parents or your in-laws) are your absolute property (Stridhan). Withholding them constitutes criminal breach of trust under the law.

Educational Certificates: These are your exclusive personal property. Your in-laws have no legal authority or right of lien over your degrees.

2. Threat Regarding Instagram Access

Do not panic. Avoid logging into or tampering with his accounts any further. The threat is primarily an intimidation tactic to counter your infidelity allegations.

3. Preserving Digital Evidence

Keep the original recordings, screenshots, and chat exports safely backed up on a secure private cloud storage (accessible only to you) or an external hard drive.

4. Checklist Before Leaving the Matrimonial Home

Secure Personal Belongings First: Quietly collect and carry all your original identification cards (Aadhaar, PAN, Passport, Voter ID), financial documents (bank passbooks, cheque books), and whatever jewelry/valuables you can safely access right now.

Inventory: Make a clear written list (with photographs/bills, if available) of all remaining gold and certificates still in their custody.

Safety & Representation: Inform trusted family members before you exit. Once in a safe location, engage counsel immediately to issue a legal notice for the return of your remaining Stridhan and documents, and proceed with appropriate maintenance or matrimonial petitions.
