Dear Client,

Based on your query, Since the vehicle was deliberately damaged by unknown persons, you should immediately lodge a written complaint/FIR with the concerned Police Station, enclosing the dashcam footage, photographs/videos of the damage, vehicle documents and workshop estimate/repair bills. The complaint should specifically mention the date, time (around 2:15 a.m. on 27.09.2026), location and the acts of the persons sitting/climbing on the bonnet and roof.

The police may investigate the CCTV/dashcam footage and identify the offenders, against whom appropriate criminal proceedings for mischief/damage to property and other applicable offences may be initiated. If the offenders are identified, the client may additionally seek recovery of the repair expenses/compensation from them.

Dear Client

Since your newly purchased Brezza was deliberately damaged by unidentified persons, you should take steps to document the incident, report it to the police and notify your motor insurer.

First, preserve the original dashcam footage showing the incident. Keep copies of photographs of the damaged bonnet, windshield and roof, the vehicle registration certificate, repair estimates, invoices and any available CCTV footage from nearby houses or the Ganesh Puja pandal. Obtain a written statement from your chauffeur describing what happened, if possible.

File a written complaint with the concerned police station with complete details regarding the date, time, place and manner of damage done. Ask for proper investigation and identification of the perpetrators. Intentionally damaging someone else’s vehicle could make one liable criminally under certain sections of the Bharatiya Nyaya Sanhita, 2023. Get an acknowledgment or complaint number.

Apart from this, you will have to intimate your motor insurance company and see if the damage is covered under your own-damage policy. In case the repairs have not yet been initiated, you will have to see the procedure for inspection and survey by your insurance company. In case the repairs have been initiated, get the photographs, estimates and invoices ready.

I hope this answer helps. If you have any further query kindly do not hesitate to contact us. Thank you.

Dear Client,

Firstly, get the workshop repair estimate in writing first, because it decides how the offence is treated. This is mischief under Section 324 of the Bharatiya Nyaya Sanhita, 2023, and where the damage is around one lakh rupees or more, it is punishable with up to five years and is cognizable, meaning the police must act. A much smaller figure attracts a lighter, maybe non-cognizable offence. File a written police complaint with the footage, photographs of the damage, the estimate and your RC copy, asking that the footage be seized and the persons identified. If the police refuse, write to the Superintendent of Police under Section 173(4) BNSS, and then apply to the Magistrate under Section 175(3) BNSS.

Secondly, inform your insurer immediately, and malicious damage is normally covered within the own damage section of a policy, insurers also ask for the police report, so file that first or at the same time. Do not let the workshop finish repairs before the surveyor inspects the vehicle, if work has started, tell the insurer at once and ask for an urgent inspection. Weigh the repair cost against your deductible and the no claim bonus you would lose. Lastly, once the persons are identified, you can also recover the cost from them civilly.
