Ownership of land my father purchased

► My father purchased a land in 1964 and the sale deed states that the land will be transferred to his son and grandson in case of his death. My paternal uncles filed a partition suit in 2017 for that piece of land seeking an equal share and the case is now in civil court under mediation. My father is very ill now and he cannot attend the court case. I want to know whether in case of his death, the land will still be in dispute or it will be transferred to me automatically as mentioned in the sale deed. What happens to the court case in case he expires while the case is pursued? Will I be made a party automatically to pursue the case?

Dear Sir,

The case will not end just because your father dies — the dispute over ownership continues.

As per Order 22 of the Code of Civil Procedure (CPC), when a party dies during a case, their legal representatives (LRs) are brought on record.

You (and any other legal heirs) will have to file an application to substitute your name(s) in place of your father.
