► A false suicide (BNS-108)case is deposed by CJM after Police Final report and complainant statement in CJM court. 1) can complainant back track his statement and challenge CJM order in higher courts ? 2) shall we request highcourt to quash the FIR or CJM order is sufficient to safeguard against any future proceedings as complainant himself have given statement in court.

  1. 1. No. Complainant cannot in personal capacity challenge CJM order. It is a state case so only state can challenge CJM order. 
  2. 2. If CJM has ordered for closure of case then there is no need to approach high court for quashing of FIR but if there is no closure order then approach high court for quashing.
