► Sir, a man told me that he would give me a subsidy tractor worth 2 lakh 10 thousand. But until now he hasn't given me either the tractor or the money. I had given him the money in 2 installments. The first was 70 thousand on 25/05/2015. Again, I paid 1 lakh 40 thousand on 11/05/2015. There is proof of the first installment on a page with his signature, where he mentions the agreement of receiving 70 thousand. However, he did not give his signature for the second installment either. There are 2 or 3 call recordings where he admits that he has taken 2 lakh 10 thousand from me. Please give me some guidance. Will I get my money back?

You need to engage an advocate and send a legal notice demanding refund of the amount you have given within a timeframe of 7-15 days. Mention that if the person fails to repay the amount, you will initiate legal proceedings for the same. 

If the person gives no response, then you can approach the nearest police station and file a ‘First Information Report’ for cheating and criminal breach of trust. Since you have proof of first installment and call recordings where the person admits taking the total amount, you have strong grounds for filing a criminal complaint. 

 

Alternatively, you can file a suit for recovery of money in a civil court, demanding repayment along with additional compensation for harassment caused. Secure your call recordings in a pen drive, keep copies of the signed document for proof.
