► Third Party involves to sell my flat giving 10% advance and made agreement with conspiracy signed too. And now a legal person was emphasizes to vacate my flat otherwise Police will vacate my flat. Due to some personal reason, I am unable to vacate in manth. What should I do.?

Firstly, police officials cannot evict you from your own property in a civil dispute. Eviction can only be done by a Civil Court order. Third party has given you 10% advance and made an agreement but the agreement is not a sale deed, it is only an agreement to sell which does not give any authority to the third party to transfer the ownership. You are still the lawful owner of the property. 

 

Steps you can take:

1. Refund the 10% advance amount if you are unable/do not want to proceed with the sale.

2. You may file a police complaint that you are being harassed by the third party.

3. You may also file a civil suit for injunction to restrain the buyer from forcefully entering your property.
