► My Maternal Grandmother has died with a will stating her property to be equally distributed in her Elder Son, Daughter 1, Daughter 2 and Daughter in Law & her Son of Grandmothers Deceased Son. Grandomther had a Flat in SRA Scheme. I Want you to find legal process to transfer and selling process so that the property can be equally distributed in legal heirs. Elder son has his name SRA Scheme Papers as he was living with her in the house. Other legal heirs don’t trust this Elder Son,. We just want to know safe way to sell this property and get equal share

Dear Sir, as per your query,

 

Even if the will is genuine, obtaining probate from the competent civil court is strongly advised.

Prepare a legal heir certificate from the local revenue office / tehsildar listing all heirs mentioned in the will.

Keep ready the grandmother’s death certificate and proof of relationship (birth certificates, Aadhaar, etc.).  Submit a formal application to the concerned Slum Rehabilitation Authority office for transfer of the flat from grandmother’s name to the names of all legal heirs as per the will and probate order.

Probate copy of will

Legal heir certificate

Identity and address proofs of all heirs
