► The present case FIR has been registered on the basis of statement made by complainant Gurwinder Singh alias Pappi stating therein that his wife namely Kiranpal Kaur remained Sarpanch of village Maha Singh Wala for the tenure from the years 2018 to 2024. During this period, co-accused Prithvi Singh remained posted as Panchayat Secretary 1at village Maha Singh Wala. During her tenure, his wife executed numerous development works in the village. On 03.01.2025 Prithvi Singh, Panchayat Secretary called him on his mobile phone, which he could not pick up at that time. After some time, he called Panchayat Secretary on his mobile phone who told him that an audit with regard to development works, executed during the tenure of his wife, is to be conducted. Earlier also they had paid Rs.20,000/- for audit of two years and now Rs.20,000/more is to be paid. He pleaded him that he already has paid enough money and he could not pay anything further, to which Panchayat Secretary asked him that this time he will get the audit of two years conducted against payment of Rs.20,000/- only and asked him to give him Rs.20,000/- during that week itself. At this, he made a false promise to him to pay a bribe, but he had recorded this conversation in his mobile phone. On 08.01.2025 again Panchayat Secretary called him and told him that Devinder Kumar Bansal, Audit Inspector, is demanding the money and has told that in case money is not paid, then he will adversely record the audit report against him. As such, they asked him to reach in his office to hand over Rs.20,000/-, so that it may be paid further to Devinder Bansal, Audit Inspector. After registration of FIR, trap was laid and coaccused Panchayat Secretary Prithvi Singh was caught red handed and the amount of bribe demanded and received by co-accused was recovered from him. It is submitted that the challan has already been presented and charges have already been framed against the applicant/accused.
