► My wife filed divorce all the counceling stages are completed then counter stage last chance I appoint one advocate he filed vakkalath with adjournment so court give next hearing for counter now he ask much more money so I want to withdrawn that advocate and i want to file a counter as party in person so can any one give a advice for me

You can file your own counter by appearing in person. 

No need to do anything. 

Just draft your reply and get it signed and notarised according to the court norms. 

Appear in person and tell the court that you wish to appear in person. 

Before that draft a petition to appear in person and submit it on next date of hearing.

Dear Sir,

 

Withdraw Your Advocate

You must formally revoke the Vakalathnama (the authorization you gave your lawyer).

Option A – By Filing a Memo Yourself

Prepare a Memo of Appearance and Revocation of Vakalathnama.

In that, mention:

“The respondent submits that he has decided to conduct the case as party-in-person. Hence, the Vakalathnama earlier filed by Advocate [Name] is hereby revoked.”

Sign it and file it before the same Family Court.

Option B – Through Advocate’s No-Objection

If possible, request your present advocate to file a ‘No Objection Memo’ (NOC).

Most courts prefer this, but it’s not mandatory if you appear in person and inform the Court that you’re revoking it.

Once filed, the Court will record that you are appearing “party in person” from that stage onward.

Yes, you can file your reply or counter in person but before that you have to discharge your advocate and also to have his NOC.
