► Sir, I owned a Maruti 800 Std. Car, manufactured in 2004, registered in 2004 and sold the said car to someone in July 2025. The car is now 21 years old. After selling the car I was required to transfer the ownership of the car in favour of the purchaser. I approached a person (the agent) to do the needful in this regard and handed over the requisite amount as agreed upon as well as all the required documents on July 12, 2025. The RC of the car was valid upto 12th October, 2025. Thus a period of three months were remaining at the disposal of the agent to do the needful. However, the agent has not done the needful during the last three months and the validity of the RC has meanwhile also expired. The ownership still remains in my name. Now for transfer of the ownership of the car to the purchaser, I am first required to renew it in my name. It will cost me a lot, say a few thousand rupees because the car is not only 21 years old but also for the reason that the renewal will take place after expiry of the validity period of RC. Kindly guide me what action I can take against the agent for this type of serious lapses on his part.

Dear Sir, as per your query,

 

You should send a legal notice to the agent asking for explanation and immediate refund of the amount you have paid. Give a deadline of 15 working days to respond. Keep all proof of payment to the agent, copies of RC, insurance. 

 

If the agent does not respond, you can file a consumer complaint for negligence and deficiency in service the agent and ask for refund, compensation for mental harassment and litigation costs. 

 

Simultaneously, you can file a complaint at the local police station and RTO where the agent is registered or operates.

I am pretty sure that all this is just verbal and you have no legal documents. 

As such, there is not much to offer apart from the fact that you can sue this person for fraud, cheating, criminal breach of trust.
