Generally it takes tentatively 3 years in ideal condition in getting case adjudicated at trial court but exact time period. On examination of agreement and other facts of the case other possible remedies too can be explored. It there is breach and violation on part of erring party then through advocate you can get issued legal notice claiming termination, damages etc subject to terms of contract. Criminal recourse can also be explored but that should be first step. If required you may consult with details.
Dear Sir, as per your query,
Firstly, check the ‘Jurisdiction’ mentioned in the Agreement.
You should first send a Legal Notice to Code Brew Labs and its Directors demanding:
1. Immediate release of the source code.
2. Rejection of the false F&F Agreement.
3. Warning of criminal & civil action for breach of trust, extortion and fraud.
4. Immediate compensation for harassment, breach of contract.
If the company does not respond to the legal notice, a police complaint needs to be filed for cheating, fraud & criminal breach. Simultaneously, a lawsuit needs to be filed for breach of contract and damages in a Civil Court.
