► I had an axis bank credit card which I used to use very less. On August 2nd I got a call from axis bank employee and he talked to me for more than 25 mins. He said you have not used your reward points and they will expire. It was the truth that I had not used reward points any time before for axis bank card. He said that first time rewards redemption is only with the help of axis bank employee. He also asked to increase my card transaction limits to maximum so that rewards can be covered totally. He then gave me a website where he asked me to enter card details. I entered. Then I got an SMS of otp for a transaction of Rs 92000. Now I knew that I was cheated. I did not enter the otp but then I got the confirmation call from bank regarding the transaction. I entered '6' which was the option representing fraud but still I got the message confirming transaction. A few secs later I got another SMS of otp of transaction of Rs 90000. This time I did not get any further call and transaction happened though I did not enter any otp. After few secs I got sms that my account is blocked due to wrong otp entered. I immediately informed bank. Bank is always saying that it is a valid transaction because otp have been entered (I did not entered otp). Scammers somehow knew the first 2 otps. They failed only in 3rd otp. I had done a police cyber crime complaint. I also talked to rbi omburdsmun. I had done a small transaction of around rs 400 on that card in that month so I paid that amount before the bill came and threw the card in dustbin. Now I got the bill of around Rs 183000 in the month of August. Axis bank has been severely torchering me since that month as I have not paid that bill.

Dear Sir,

You can take the following additional legal steps if needed:

Send legal notice to Axis Bank (through advocate) demanding reversal and withdrawal of harassment.

If unresolved, you can file a consumer court complaint for deficiency in service, mental agony, and harassment.

Consumer forums have often ruled in favour of customers in similar OTP-bypass scams when timely reported.

Example cases:

RBI Ombudsman vs ICICI Bank (2019) — Bank ordered to refund as OTP was not shared by customer.

Axis Bank vs Renu Sinha (2021) — Bank held responsible for failure to prevent fraud.

You are immediately required to send a legal notice to Axis Bank, asking them to restrict the interest, penalty and charges and consider your genuine case of cyber fraud.

Your problem is cyber crime. If you have validly registered the complaint with the cyber crime PS and informed your bank simultaneously it's the Bank who should act and cyber police station is to look into the matter legally. If nothing happens you should approach the competent Lawyer and proceed ahead legally. Bank can be arraigned in consumer dispute also with demand of fraud amount reimbursements along with compensation for harrassment and mental agony. There are two things you need to understand first. 

 

  1. Card was in your name. 
  2. Any billables of that card need to be paid by you (Legally) 

 

Now coming to your situation. Like you said you have already raised a cyber complaint and informed the bank immediately. 

Talk to the police authorities and if they do not take any action take necessary steps to ensure that such cyber fraud is curtailed. Find the accused(s). You can take help of an Advocate to discuss what needs to be done. 

 

Now, that the Bank is harassing you. 

Consult an advocate and ask him to write a representation to the Bank stating the factual matrix. Post which legal measures as against the Bank can be taken. 

 

Things which we need to know before you do this. 

 

A. Did you verbally tell them any OTP? 

B. You said you did not enter the OTP, did you give them any virtual access or click any sort of link ?
