► The matrimonial case 2235/2022 for my cousin, Sandeep J.S., is not getting listed in the Bangalore High Court, and this situation has become a matter of life and death for him and his family. They are suffering greatly due to the delays in the divorce appeal. We have lost confidence in our advocate, who is the third one we have hired. What can we do next to bring the case in front of the coram? I would greatly appreciate any advice.

Hello, 

 

Mention your case before the Hon'ble Court with urgency of listing. 

This is the only possible mode. Else, file a petition before the Supreme Court of India for expeditious disposal of your case and get an order and thereafter mention.

Dear Si/Madam,

 

Since you’ve lost faith in your third advocate, you can change counsel formally:

Engage a new advocate and execute a Vakalatnama in his/her name.

The new advocate should file a Memo of Appearance and No-Objection Certificate (NOC) from the previous counsel.

If the old counsel refuses to give NOC, the new counsel can file a memo seeking leave to appear without NOC, citing non-cooperation.

After substitution, the new counsel can immediately file the Memo for Early Listing.

Good advocates familiar with High Court registry procedure can often get a matter listed in days if there are no technical defects.

File an Urgent Hearing Memo: Submit a Memo for Urgent Listing before the Registrar (Judicial) of the Karnataka High Court, citing the life-threatening urgency and prolonged delay in listing MFA 2235/2022.

Mention Before the Bench: Have your cousin or a new advocate mention the matter in open court  before the Division Bench handling matrimonial appeals, requesting early listing or hearing.

Change Advocate if Needed: If the current lawyer is inactive, file a Memo for Change of Counsel and appoint a new High Court practitioner experienced in family appeals to pursue urgent listing.

Representation to Registrar General/Chief Justice: If the case remains unlisted despite efforts, send a formal representation highlighting the hardship and requesting administrative directions for immediate listing.
