If a father’s property is being divided between two sons, the rules depend on what type of property it is — self-acquired or ancestral — and whether the father is alive or deceased.
1. If the Father is Alive
(a) Self-Acquired Property
The father has absolute rights over his self-acquired property. He can gift, sell, or will it to anyone he wishes — not necessarily his sons. Sons cannot claim a share during his lifetime. Division happens only if the father chooses to divide or bequeaths through a will.
(b) Ancestral Property
If the property is ancestral (i.e., inherited by the father from his father/grandfather without partition): The sons acquire a birthright in it. The father cannot deny their share or gift/sell the entire property without their consent. Each son gets an equal share with the father.
