Dear Sir, as per your query,

You cannot legally replace the biological father’s name in the children’s documents merely because of remarriage or financial care. In India, such a change is permitted only through a legal adoption or a specific court order.

The correct and permanent solution is step-parent adoption. After the adoption order is passed by the Family or District Court, you can apply to update all records like school documents, Aadhaar, passport, and other IDs, based on the court decree. Schools and authorities will accept the change only when supported by such an order. collect your marriage certificate, the children’s birth certificates

Dear Sir,

Children are below 18 years

Biological father is alive but absent / non-supportive

Consent of biological father is normally required, BUT
Court can waive consent if:

He has abandoned the children

No maintenance / no contact

Divorce decree supports this

Welfare of children demands adoption

Courts are very child-centric in such cases.
