Child has independent right of inheritance etc. and the same cannot be taken away by parents by their settlement. Child on attaining majority can claim. For other remedies details are required to be examined.

Dear Madam,

Can a case be filed while you are outside India?

Yes. 100% legally permissible.

Indian law allows NRIs / persons abroad to file and conduct cases through:

Power of Attorney (PoA)

Advocate representation

Video conferencing (for evidence, if permitted by court)

You do not need to be physically present for filing or initial proceedings.
