Brand name copy by other company

It is a case of infringement of copy right. File suit for permanent and mandatory injunction and damages.

Even without registration, protection exists if:

You were using the brand first

Your brand has goodwill/reputation

The other party is misleading customers

Example:
Local shop copying a known business name/logo to gain customers

Under Sections 103 & 104 of Trade Marks Act:

Police complaint

Seizure of goods

Imprisonment up to 3 years

Fine up to ₹2 lakhs

(Used in counterfeiting, fake brands, duplicate goods)
