► I have exchanged my Old Two Wheeler to purchase a new bike from a Bajaj Showroom in June, 2014. They told that the bike would be scrapped. But with out my notice or proper registration transfer they sold it to an another party. It came my notice in Oct, 2015 after receiving a police challana for the old bike. I was so worried that the person who is riding the bike had committed any illegal activity with the bike. I informed the showroom but their response is showing their full negligence in this matter. Can we take any legal action on them?

Yes, legal action can certainly be taken against the Bajaj showroom, and on the facts stated by you, the law is clearly in your favour. When you exchanged your old two-wheeler in June 2014 on the clear representation that the vehicle would be scrapped, a contractual and legal duty arose on the showroom to ensure lawful disposal of the vehicle and proper transfer or cancellation of registration under the Motor Vehicles Act, 1988. You may initiate proceedings before the Consumer Disputes Redressal Commission for “deficiency in service” and “unfair trade practice.”
