► need legal guidance regarding property damage caused by a neighbor.
Behind our house there is a drainage channel (kul). Our neighbor regularly releases wastewater from washing clothes into this channel from the back of their house. Due to the continuous flow of dirty water, the rear walls of our house have developed heavy seepage and dampness, and the structure is getting damaged.
We have complained multiple times to the Panchayat, but no effective action has been taken. The neighbor openly says the drainage channel is “government property” and that he will continue to discharge wastewater there despite the damage to our house.
This ongoing issue is affecting our property and living conditions, and the damage is increasing over time. We want to take proper legal action to stop this and protect our house.

Send a legal notice through a lawyer to the neighbour demanding immediate stoppage of wastewater discharge causing damage. If it continues, file a civil suit for permanent and temporary injunction under nuisance and property law. High chances court will pass favourable order.
If urgent damage continues, approach the Executive Magistrate for removal of public nuisance. This is a fast remedy and can result in an immediate order stopping the discharge.
