Approaching the Controlling Authority (Under the Payment of Gratuity Act, 1972):
This is the most common and effective first legal step.
File a Complaint (Form I): As an eligible employee, or through a person authorized to act on your behalf (or nominee/legal heir in case of death), you should file a complaint in Form I (or Form N in some cases) with the Controlling Authority appointed under the Payment of Gratuity Act. This authority is typically the Assistant Labour Commissioner (Central or State, depending on the establishment's jurisdiction) of the area where the employer's establishment is situated.
Time Limit: Ideally, this application should be made within 30 days from the date the gratuity became payable. However, delays can be condoned by the authority if there are reasonable grounds.
