Dear Client,
Firstly, you need to prepare a lengthy report regarding the amount that has been given to the field crew. The report must contain details like the date when the amount has been paid out, the amount given to them, the method used for paying the amount, the name of the field worker who received the amount, and the receipt or whatsApp message.
I will advise you to draft a complaint letter both electronically and physically addressed to the NBFC’s Grievance Redressal Officer stating that you received the money through an authorized agent from the company and that the information conveyed regarding the matter by the credit department is incorrect and defamatory. Demand immediate closure of the notice issued to your employer and correction of the loan account status.
At the same time, I will advise you to lodge a complaint against the NBFC for harassment towards the borrower who has already paid by filing one on the RBI's Integrated Ombudsman website at www.cms.rbi.org.in. This is something that the RBI looks into with seriousness, especially if notice was served to the employer from incorrect records.
If the notification sent to your office has already caused embarrassment to you, then it would be a valid ground for seeking compensation from the Consumer Dispute Redressal Commission for Defamation and Mental Harassment.
Dear Client,
If you have paid Rs.36,000/- to the NBFC field team representative then you should immediately find proof of such payment, such as receipt, screenshot, whatsapp chat, call recordings or any acknowledgement from the field executive. After which you should email the redressal cell/committee of the NBFC informing the payment of Rs.36,000/- to the field executive attaching all the available proof and wrongfully blocking your loan transaction by the credit team. Also mention the notice issued to your office by the NBFC credit team. Request them to make the necessary corrections in their records, withdraw the recovery action and a written confirmation of loan closure or adjustment of the payment given by you. If the NBFC does not respond, fails to resolve the issue or continues to harass for payment of the money you may file a complaint to the RBI Ombudsman or any other appropriate consumer forum for deficiency of service.
I hope this helps and if you have any further issues do not hesitate to contact us.
