Dear Client,
In case DAVV University has placed you in the Unfair Means (UFM) case and cancelled your examination papers because 25 words of summary were written on the reverse of your admit card, then the main problem is about whether you were provided a proper chance to defend yourself and if UFM process was conducted according to the procedure of the University. In case if the notes were not used during the examination and the punishment was awarded to you without conducting a fair hearing, then you can take the matter to the higher authorities within the University and even file a writ petition in front of Madhya Pradesh High Court on the grounds of violation of natural justice or disproportionate punishment.
I hope this helps and if you have any further issues do not hesitate to contact us.
Dear Sir,
Before approaching the High Court, you should carefully examine the university's UFM rules and the order passed against you. The important questions are whether you were issued a show-cause notice, whether you were given an opportunity to explain your case, whether a UFM committee heard you, and whether the punishment imposed is proportionate to the alleged misconduct. If the university cancelled your paper without giving you a proper opportunity to defend yourself, you may have grounds to challenge the decision on the basis of violation of the principles of natural justice.
If the summary written on the admit card was unrelated to the questions asked in the examination, or if it was discovered before the examination commenced and before you had the opportunity to use it, these facts may support your defence. Similarly, if the university rules distinguish between mere possession of material and actual use of material, that distinction may be relevant in your case.
