Able-Bodied Child forcing mother to provide for her despite being 36y

► Okay so my mother (50+) is the only working and earning member (who got my deceased father's job). I have a 36 year old sister who has no body disabilities but still completely denies working and earning and supporting either herself or the family, and simply stays at home for the last 14 years... However, in this timespan, she has turned abusive towards my mother, including daily arguments and sometimes even physical too. As a result, my mother has become a BP and a heart patient yet still goes to work everyday. Is there some civil/legal action we can take to get rid of the sister. Please help.

Dear Client,

If your 36-year-old sister who is an able-bodied adult without any disability is violent to your mother, your mother is not required by law to support her even though she is jobless. In case the house in which they live belongs to your mother alone (either self-owned or allotted only to her), your mother can request your sister to leave and if your sister does not agree, your mother can file legal action against her for eviction. In the event that there are acts of violence, criminal intimidation, and harassment by your sister, your mother can register a complaint before the concerned police station under the relevant sections of the Bharatiya Nyaya Sanhita, 2023, and if she is a senior citizen, then she can apply for relief under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, along with life and property protection if needed. It will depend on the ownership of the house and the facts of the case what needs to be done.
