Cyber Crime
► I have been a gambling addict since 2 years and unemployed. I deposit money online to online betting sites from time to time, which i lose, sometimes i win. 2 days ago, I deposited cash of 4500(given by my family) to my bank account. Suddenly, i tried to pay some vendor and the UPI app shows insufficient balance. I contacted the bank right away and found that 4518 rs was on lien by cyber police. I met with the manager of the branch and he told me to avoid using the account for a few days and wait for the official notice. I have the 4500 rs deposit slip but the remaining 18 rs could be fishy. Should i wait for notice or just wait out 90 days before approaching the bank again. What should i do? I am even ready to surrender the entire disputed amount for the lien to be removed.

Dear Client

A lien or freeze placed by the cybercrime authorities generally means that the bank has received instructions in connection with an investigation, often relating to a disputed transaction, suspected fraud or a complaint involving money that has passed through the account. The fact that the amount under lien is ₹4,518, while you deposited ₹4,500 in cash, does not by itself establish wrongdoing, but the exact reason can only be known from the bank or the investigating authority.

The issue should not be overlooked or left alone for 90 days without doing any investigations. The lien details such as the name of the investigating police station, complaint number, reference number, and officer's name, if possible, should be obtained in writing from the bank. Make sure you keep your cash deposit receipt and bank statement indicating the source of money.

It should be noted that activities related to unauthorized betting or gambling websites could draw attention depending on the nature of the transaction and law. You should cooperate with the authorities and give the documents if demanded.

The person is not supposed to surrender the sum unless he is asked by an authorized institution or understands the reason for the lien. In case no notification is received in time, one should consult the bank.

Dear Client,

Do not wait, as most likely someone filed a complaint on the National Cybercrime Reporting Portal, and the hold travelled down the chain of accounts the disputed money passed through. An account can be lien-ed for receiving funds traceable to that chain, with no allegation against you. Betting site deposits and payouts often route through intermediary accounts, which is a common way ordinary accounts get caught. Write to your branch for the lien details in writing- amount, date, complaint number, and the police station or cybercrime cell that marked it. Then approach that cell directly with your deposit slip and statement showing the cash credit, and ask what is needed for release. You can also file a representation to the investigating officer seeking defreezing on proof of legitimate source. Release normally follows the officer’s clearance or a court direction, since the bank cannot lift it on its own. There is no automatic 90-day expiry. Do not offer to surrender the amount before knowing the basis, as it can read as acknowledging a claim. If unanswered, escalate to the bank’s officer, then the RBI Ombudsman.
