If it is a Motor Accident Claim (MACT / M.V. Act case):

Courts usually proceed ex-parte against absent parties if they fail to appear repeatedly.

Ex-parte means your claim can be heard and decided even without the opposite party.

Court may issue:

Ex-parte notice / orders to proceed

Adjournment warnings before deciding ex-parte

Insurance Company:

If opposite party is insured, the insurance company may appear.

Even if the person is absent, insurance company can be made liable under the MV Act.
