► Two brothers got money by providing cheque. When presented in bank, we got letter that one cheque is account closed and other cheque is non CTS cheque. Can we able to file fir in police station for fake cheque.

Dear Sir, as per your query,

 

1. Account Closed Cheque

This is considered dishonour of cheque under Section 138 of the Negotiable Instruments Act, 1881 (NI Act).

Reason “Account Closed” is legally same as insufficient funds.

You should issue a legal notice within 30 days of receiving the bank return memo.

If payment is not made within 15 days of the notice, you can file a cheque bounce criminal complaint in a magistrate's court.

Report the matter to police. Thereafter, file complaint case under 138 N.I. Act and also recovery suit.
