► Mr friend was driving car, a police person come on bike and slaped hardly and choked neck. My car didn't touch his bike, he was saying that is wrong way, you can't go, while there is no where written that is wrong way or one way. Many vehicles used to go that way. There is some scratch marks are there on neck and some pain in throat. Then after he took me to his police chowki and abusing and threatening to beat me inside the room. He checked my DL and then he allowed me to go. But i don't have any other proof, witness or VDO recording. What can i do against that police person.

Law enforcement cannot legally beat anyone for purported traffic offences. Even in the absence of video proof, you must go to a government hospital right away for a medical examination. With the medical report of your injuries, you can lodge a proper complaint for assault, illegal detention, and criminal intimidation with the local Superintendent of Police (SP) or Commissioner. If the police fail to act on your complaint, you may prefer to approach the State Police Complaints Authority (SPCA) or the State Human Rights Commission (SHRC). Furthermore, an advocate can help you in filing a private criminal complaint before a Magistrate in appropriate cases.

Get a Medical Examination Immediately. Go to a Government Hospital or Medical College and get a medical report documenting:

Scratch marks on neck,

Pain and difficulty swallowing. 

 

You can submit a written complaint describing the incident in detail. There are multiple ways to do this:

 To the Superintendent of Police (SP) / Deputy Commissioner of Police (DCP)

Address your letter to the SP/DCP of your district.

If you know the name of the police officer, file a complaint and get your complaint registered to a FIR. Ensure that you have a medical done and submit MC.
