The Customs officer will prepare a Panchnama / Seizure Memo.
The person will be asked to give a statement under Section 108 of the Customs Act (this is admissible in court).
If the officer is not satisfied with the explanation:
A formal case will be registered.
The money may be confiscated.
The person may be sent to judicial custody.
If foreign currency was involved, FEMA or COFEPOSA (foreign exchange/smuggling laws) may apply.
Bail and Release Options
The lawyer can immediately apply for bail before the Chief Metropolitan Magistrate (Customs Court), Esplanade, Mumbai.
