Effect of your remarriage

Your remarriage DOES NOT take away:

Your 1/3rd share

Your son’s 1/3rd share

Very important point:
Rights are decided on the date of death, not later events like remarriage.

So:

Your ownership remains intact

Your son’s rights remain intact

Can mother-in-law claim now?

Yes, but only to the extent of her 1/3rd share, if:

There was no Will, and

She has not relinquished her right earlier.

She cannot claim the entire property or disturb your and your son’s shares.

You, your son and mother in law are class-1 legal heirs of deceased husband and class-1 legal heirs are entitled to equal share in the properties of deceased husband. Your remarriage does not effect your right.

Your mother-in-law does have a right in your late husband’s self-acquired property, and your remarriage does not cancel your own or your son’s rights in that property.
