Dear Client,

It is extremely unfortunate to endure hostility in your workplace along with failing authorities. If the police do not listen to your plea and refuse to register an FIR against your abuser, you could file a complaint against your matter to the SP as per the provisions of Section 173(4) of the Bharatiya Nagarik Suraksha Sanhita (BNSS). If you do not have any necessary support from the SP, you may file a private complaint in the court of the Judicial Magistrate as per the jurisdiction laid down in Section 175(3) of the BNSS. The Judicial Magistrate may, thereafter, order the police to register your FIR. Further, if the misconduct committed by the staff amounts to sexual harassment, you may file a complaint as per the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (POSH Act) to the Internal Committee (IC) of the hotel or the Local Committee of your district. Regarding the management trying to compel you to drag your parents into this matter, being a legal adult, you are not obliged to bring your parents to the resolution of your workplace conflict. You may write a demand notice to the hotel management regarding such developments. Approaching the District Legal Services Authority (DLSA) or the local labour commissioner can provide you with free legal counsel to protect your rights.

I hope this answer helps. If you have any further query kindly do not hesitate to contact us. Thank you

Dear Sir,

File Complaint under Section 156(3) CrPC before JMFC Court

File an application before the Jurisdictional Magistrate

Mention:

Police refused to register FIR

Continuous harassment and intimidation

Employer coercing you to involve parents

Magistrate can ORDER police to register FIR

You better leave that job and pick another one for better future or take help of some social activist or Police personnel to sort out the issue in the existing job. Conducting environment at the job place is must for job satisfaction as well as future growth prospects.
