Cbse college witholding my niece's clc and iriginal 12th. Certificate due to some arrear fees

► My niece was studying in a cbse pattern college in bbsr. There is some fees of the college remains unpaid bcoz her parents are not in a position to pay. The college refused to give her clc and 12th certificates. The college also took her original 10th. Certificate as collateral, and refusing to give it back unless the full ammount is paid.Due to this her one year is lost already and this year also will be lost it seems. She is in a state of depression due to this mess. What legal remedies does she have to comoel the institute to give back her certificates and clc so that she could take admission in further courses.

As per multiple High Court and Supreme Court rulings, educational institutions cannot withhold original certificates or mark sheets due to non-payment of fees. Doing so is considered illegal, arbitrary, and against the right to education under Article 21 of the Constitution of India.

college cannot keep it like that, you can give a representation to the college for returning the Documents and thereafter file a Writ Petition.

Your niece has the legal right to get back her original certificates like the 10th and 12th marksheets and CLC because educational institutions are not allowed to keep a student's original documents for non-payment of fees. The University Grants Commission and CBSE both have clearly said that no school or college can hold certificates as collateral. She or her guardian can first send a written request to the principal or management asking for the return of documents. If they still refuse, you can file a complaint before the District Education Officer, the CBSE Regional Office, or the State Education Department. She can also file a writ petition in the High Court under Article 226 of the Constitution, asking the court to direct the college to return her documents. Courts have earlier ruled in favor of students in similar situations. This legal step may help her get her certificates back and continue her education.
