About Our Best Mutual Divorce Lawyers in India

In Hinduism, marriage is considered a sacred religious ceremony where a man and a woman unite in a lifelong commitment, following the principles of dharma. The word 'divorce' comes from the Latin word 'divortium', which is a combination of the words 'dis' and 'apart'. Disparity means difference and vertere means turn. Divorce in a marriage under the Hindu Marriage Act, 1955 is defined as the termination of the marriage. Society is constantly evolving, and as a result, the regulations governing it are also undergoing changes. Therefore, in order to protect the interests of society, the legal framework should ensure the preservation of the marital bond for the purposes outlined by the law. Divorce is only allowed if it is necessary for a grave reason or if there are no other viable alternatives. At onlinelegalquery, we understand that going through a divorce can be a difficult and emotionally taxing experience, both legally and personally.

Our team comprises experienced divorce lawyers in major cities of India, such as Delhi, Bangalore, Mumbai, Chennai, Hyderabad, Pune, and Kolkata, who offer expert legal guidance and support. Types of divorce: In India, there are only two types of divorce - mutual divorce and contested divorce. Mutual divorce: if both spouses mutually decide to end their marriage, it is referred to as mutual divorce. Section 10a of the Indian divorce act, 1869 permits divorce by mutual agreement for marriages under the special marriage act, as well as section 28 of the special marriage act, 1954, which allows marriages under the said act to be dissolved by mutual consent. Section 13b of the Hindu Marriage Act, 1955 grants Hindus, Sikhs, Jains, and Buddhists the option to obtain a divorce through mutual agreement. According to section 32b of the Parsi Marriage and Divorce Act, 1988, Parsis have the option to obtain a divorce through mutual agreement. Muslim personal law also permits divorce through the khula and mubarat. Contested divorce: a contested divorce is initiated by one spouse who desires to end the marriage, while the other spouse is not interested in pursuing the divorce. It means that the decision of separation is not made jointly by both parties, but rather only by one party. Adultery, cruelty, desertion, mental instability, conversion to another religion, and the assumption of death are the reasons for a contested divorce. Section 13 of the Hindu Marriage Act, 1955 establishes the grounds for divorce

Mutual Divorce vs Contested Divorce

Mutual Divorce –

Contested Divorce –
