Legal Notice - What is under the envelope

A legal notice is a written document or we can also call it an official, legal written communication which gets sent by one party called ‘sender’ or in a legal way we call it ‘aggrieved party’ to another party called ‘recipient’. It is to inform them about the legal dispute. It gives an official announcement of the sender's intention to start a legal process if the demands written in the legal notice do not meet the deadline. In a one liner it is a formal and legal warning before a legal suit gets started.

When should someone send a legal notice ?

These are some considered moments for which someone can send a legal notice, but it is not  only limited to these considerations :

Breach of Contracts - One party failed to fulfill the obligation under the contract.

  • Property controversy - Any issues related to eviction, rent, illegal possession, mortgage, partition of land.
  • Cheque Bounce - Under section 138 of the NI Act, this gets filed as a criminal complaint.
  • Employment disagreements -  Illegal termination, salary dues, violation of those agreements which have been promised before.
  • Money Recovery - money issues, loan defaults etc.

Types of notice :

  1. Eviction notice - From a landlord to a tenant.
  2. Employer - To an employee from an employer for any office disputes
  3. Employee - From an employee to an employer.
  4. Cheque Bounce Notice - Probably sent by the payee to the drawer.
  5. Consumer complaint notice - By the consumer to the Business entity for defective things, faulty services etc.
  6. Divorce - By the husband or by the wife. Many more like these.

The general format of a legal notice mostly contains :

  • The sender's Details - Including name , address , description of the person.
  • Recipient’s Details - Same details as the sender’s
  • Subject - a static line that contains the whole matter
  • Facts - context of the matter that led to the grievance
  • Timeframe - A reasonable time under which the demands should be met.
  • Relevant Law - this should be mentioned
  • Signature - The sender's signature
  • Date - When notice will be issued

Respond to a Legal Notice :

The standard response time is 15 to 30 days from the date the notice gets received, but the time might vary depending on each case.

What if the Recipient Ignores a Legal Notice, Thinking it's just a letter?

If the recipient does not give an appropriate  response to the legal notice while mentioning his or her part of work fulfilling the demand ,  within the timeframe that stated in the notice, the sender can initiate a legal proceedings in the relevant court of law. Ignoring a legal notice significantly weakens the recipient's position in the litigation process.
